• I/We confirm that we have carefully read and fully understood Privacy policy of availing financing that are listed on PAHAL App at Privacy Policy
• I/We have read, understood and explicitly agree to the consent of information to be used throughout the journey.
• I/We accept the terms & conditions unconditionally and agree that these terms and conditions may be amended or modified at any time and I/we will be bound by the amended terms & conditions that are in force.
• I/We understand that sanction of the loan(s) is at the sole discretion of the Pahal and is subject to my/our execution of necessary documents, providing any security(ies) and other closing formalities to the satisfaction of Pahal. I/We agree that Pahal at its sole discretion may reject my application without providing any reasons, and that I/We reserve no right to appeal against this decision.
• I/We declare that I am/we are citizen(s) /resident(s) of India and I/we declare, warrant and represent that all the particulars and information and details given / filled in this application form and documents given by me/us to are true, correct and accurate and I/we have not withheld / suppressed any material information. I/We undertake to furnish any additional information/ documents that may be required by PAHAL from time to time. I/We understand that PAHAL reserves the right to retain/discard all documents (including photographs and financial instruments) submitted along with the loan application & may not return the same to the applicant.
• I/We confirm that I/we am/are making an application to PAHAL for availing loan, for meeting the purpose as mentioned in the app by me/us. I/We hereby confirm that the proceeds of the loan shall not be utilised for any speculative, anti-social, immoral or illegal purposes. The proceeds of the loan shall be utilised only for the purpose, mentioned hereinabove, and in compliance with the terms and conditions prescribed by PAHAL . PAHAL has the right to recall the loan facility if the loan proceeds are used for any purpose other than the declared purpose.
• As a pre-condition, relating to grant of the loans/advances/credit facilities by PAHAL to me/us, I/We agree and give consent for the disclosure by PAHAL of: I. information and data relating to me/us II. the information or data relating to any credit facility availed of/to be availed, by me/us; and III. default, if any, committed by me/us, in discharge of any our obligations, to all or any third parties as may be deemed necessary at the sole discretion of PAHAL.
• PAHAL may, as it reasonably deems appropriate and necessary, disclose and furnish information as set forth above to CIBIL and/or any other agency authorized in this behalf by the RBI. The Borrower hereby agrees that PAHAL shall be entitled to exchange information regarding our accounts with other financial institutions or banks, as and when required in accordance with Applicable Law and regulations.
• I/We undertake and acknowledge that: I. For the purpose of assessing our credit worthiness, PAHAL, is authorized to pull from CIBIL and/or any other agency authorized by RBI, data of the applicant(s); II. CIBIL and any other agency so authorized may use, process the said information and data disclosed by PAHAL ; III. CIBIL, and any other agency so authorized may furnish for consideration, the processed information and data or products thereof prepared by them, to banks/financial institutions and other credit grantors or registered users, as may be specified by the RBI in this behalf; IV. For the purpose of verification of my/our personal data, PAHAL is authorized to pull from Central KYC Records Registry, ‘Know Your Customer’ data of the applicant(s), on behalf of which this loan application is made.
• There will be no cancellation of the service once you have received the loan amount in Your bank account.
• I/We agree that PAHAL uses other third parties such as a credit/debit card processing company, payment gateway, pre-paid cards etc. to enable you to make payments for availing Services on Application. When you sign up for these Services, you may have the ability to save your card details for future reference and faster future payments. In such a case, we may share your relevant Personal Information as necessary for the third parties to provide such services, including your name, residence address and email address as available in our records. The processing of payments or authorization is solely in accordance with these third parties’ policies, terms and conditions and we are not in any manner responsible or liable to you or any third party for any delay or failure at their end in processing the payments.Suspension or Cancellation by Lender12.1 The Lender may, by notice to the Borrower, suspend the right of the Borrower to Disbursements:
• if any Event of Default has occurred and is continuing or if the Event of Default is, in the reasonable opinion of Lender, imminent; or
• if any event or condition has occurred which has or can be reasonably expected to have a Material Adverse Effect on the Borrower; or
• if the total Loan Amount is not disbursed within the time period stipulated herein.12.2 Upon the giving such notice as specified in clause 12.1, the right of the Borrower to any further Loan or disbursement shall be suspended or cancelled, as the case may be. The exercise by the Lender of its right of suspension shall not preclude Lender from exercising its right of cancellation, either for the same or any other reason specified in clause 12.1 and shall not limit any other provision of these T&C and Policies.
• I/We further authorize PAHAL to keep me/us informed (vide telephone, SMS, mail, E-mail etc.) of all promotional schemes and/or activities
• The borrower agrees that Based on the respective risk category, different rate of interest is charged to different category of customers.
